This Privacy Policy describes how SendToWin LLC ("SendToWin," "we," "our," or "us") collects, uses, and discloses information when you visit www.sendtowin.com, including its SendTech marketing pages ("Website"), or submit inquiries through the Website. Registration for, purchase of, and use of the SendTech app are addressed separately in the SendTech Privacy Policy at https://app.sendtowin.com/privacy. SendToWin managed services are governed by the applicable service agreement and privacy notices.
1. INFORMATION WE COLLECT
1.1 Information You Provide
We collect information you voluntarily submit through forms or inquiries, including your name, business email address, services of interest, monthly budget, how you heard about us, and other information you choose to provide.
1.2 Information Collected Automatically
Our Website and its providers may process IP addresses, browser and device information, operating system, screen size, pages visited, referring websites, campaign parameters, page speed, clicks and clicked-element text, and visitor or session identifiers. The information collected and identifiers used depend on the tool and settings described below. Hosting and network providers receive connection information as part of delivering the Website.
2. ANALYTICS AND TRACKING
PostHog. We use PostHog to measure Website use, including page views, engagement, clicks, clicked-element text, heatmaps, page performance, referrals, campaign information, and clicks on external links. After you select Accept, PostHog uses a first-party cookie and browser storage to recognize visits and may process approximate country information. PostHog processes IP addresses to determine approximate country but is configured not to store IP addresses. We configure analytics to exclude form answers, credentials and sensitive personal information.
Regional settings. For visitors in the European Union, European Economic Area, United Kingdom, Switzerland and Canada, and when the region cannot be determined, PostHog remains disabled until Accept is selected. Outside those regions, limited cookieless PostHog measurement operates before a selection and after Reject. This limited mode uses no cookies or browser storage, does not store IP addresses or location, and uses a daily-changing value to count unique visitors. It measures pages, clicks, referrals, campaigns, device and browser information, page performance, and external-link interactions. Reject disables PostHog's cookie-based analytics; it does not disable this limited measurement where it operates.
We apply the same prior-permission settings to browsers sending Global Privacy Control. In those browsers, PostHog remains disabled unless you subsequently make an affirmative Accept selection and applicable law permits that selection. We use approximate country information available through our host, with device time zone as a fallback, to apply regional settings. We do not retain a separate region-preference record for this purpose.
Framer. Framer hosts the Website, fonts, images and other content and processes technical connection information to provide hosting, security and performance. Its separate built-in cookieless statistics operate in every region regardless of your cookie selection. They measure visits and referrals without cookies or persistent visitor identifiers. These statistics are distinct from PostHog and are not switched off by Reject or Global Privacy Control on this Website.
Typeform. Typeform supplies the forms on /contact-form and /sendtech-api and processes the information you submit. Loading a form also enables Typeform cookies, respondent and visitor analytics, and associated service providers, including RudderStack and Datadog. In the regions requiring prior permission under our settings, and for browsers sending Global Privacy Control, forms remain blocked until Accept or a separate informed choice to load the form. Elsewhere, forms may load automatically before a cookie selection. Selecting Reject blocks the forms and further embedded Typeform tracking in every region. A subsequent Accept selection or a separate choice to load the form after seeing the cookies and usage-data disclosure permits the form and its associated technologies to load. Typeform's privacy notice provides additional information.
Campaign hand-off. Only after Accept, our code stores the referring source, campaign information or landing page in session storage and adds those values to links leading to the SendTech app. This Website feature does not itself store signup attribution in the app or determine the app's tracking settings.
We do not use Website session recording or advertising pixels. We do not currently use Google Analytics, Google Ads, Meta Pixel, LinkedIn Insight Tag, TikTok Pixel, HubSpot, Hotjar, Microsoft Clarity, FullStory or Mixpanel. 3. HOW WE USE INFORMATION
3.1 Website Operation and Inquiries
We use information to operate and secure the Website, respond to inquiries, provide requested information, and improve content, usability and performance.
3.2 Measurement and Attribution
We measure Website traffic, engagement, referral sources and campaign effectiveness using the regional and provider-specific settings in Section 2. Some cookieless measurement operates independently of the cookie choice. Campaign hand-off storage operates only after Accept.
3.3 Legal Compliance and Protection
We may use information to comply with applicable law, respond to lawful requests, prevent fraud or misuse, enforce our terms, and protect our rights and the security of the Website.
3.4 Legal Bases Where Applicable
Where applicable law requires a legal basis, we process information based on consent, steps taken at your request before a contract, contract performance, legal obligations, or legitimate interests subject to applicable legal conditions. Where consent is required, we obtain it before the relevant processing and provide a way to withdraw it.
4. HOW WE SHARE INFORMATION
4.1 Service Providers
We disclose information to providers supporting Website hosting, security, analytics, forms, communications and infrastructure. These include PostHog for analytics, Typeform and its associated providers for forms, Framer for hosting and cookieless statistics, and Cloudflare for hosted media. Our site builder may also open a technical connection to Google's font server, exposing connection information such as an IP address; our Website font files are hosted through Framer rather than downloaded from Google. Providers process information under applicable agreements and, where relevant, their own privacy notices. Independent providers' practices may differ from ours.
4.2 Business Transfers
Information may be transferred in connection with a merger, acquisition, sale of assets or similar transaction, subject to applicable law and any required notice or consent.
4.3 Legal Requirements and Protection of Rights
We may disclose information when required by law or lawful process, to enforce agreements, investigate fraud or misuse, or protect the rights, property or safety of SendToWin or others.
5. YOUR CHOICES AND RIGHTS
5.1 Communications
We use inquiry information to respond to your requests. We do not currently send promotional emails or newsletters through this Website program. Any future commercial communications will include opt-out mechanisms required by applicable law.
5.2 Privacy Rights
Privacy rights depend on applicable law and are subject to its conditions and exceptions. This Policy does not create additional voluntary access, correction or deletion rights beyond those required by law. Use the available Website controls for cookie choices. For a request required by applicable law that those controls do not support, use Section 14. We may verify identity and respond within legally required timeframes.
5.3 Cookies and Browser Signals
Select Cookie Preferences in the Website footer to reopen the Accept/Reject banner. The regional settings, limited cookieless measurement, Framer statistics and separate Typeform behavior are described in Section 2 and the Website Cookie Policy. Updated selections affect future collection and do not automatically delete previously collected information. Global Privacy Control activates the prior-permission settings described in Section 2. We do not currently respond to Do Not Track signals.
5.4 Rights Where GDPR Applies
Where the General Data Protection Regulation applies to the relevant processing, rights may include access, correction, erasure, restriction, portability, objection, withdrawal of consent, and a complaint to a competent supervisory authority, subject to that law's conditions and exceptions. Withdrawal does not affect processing lawfully conducted before withdrawal. Use the process in Section 5.2 for applicable requests.
5.5 Advertising Practices
We do not sell Website personal information or share it for cross-context behavioral advertising. We do not use advertising pixels on the Website. If these practices change, we will provide notices and choices required by applicable law.
6. DATA SECURITY
We use reasonable technical and organizational measures designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. RETENTION
We retain information for as long as reasonably necessary for the purposes described in this Policy, including responding to inquiries, operating and improving the Website, security, legal compliance and dispute resolution. Retention varies with the information, its purpose, applicable law and provider settings. When information is no longer needed, we delete or anonymize it, subject to legal retention requirements and routine backup practices. A cookie's lifetime is separate from retention of information previously collected using it.
8. CHILDREN'S PRIVACY
The Website is intended for business audiences and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If we learn that we have done so, we take reasonable steps to delete it, subject to legal retention requirements. Contact us if you believe a child has submitted personal information.
9. THIRD-PARTY LINKS
The Website links to third-party services, including external AI providers through Ask AI links. These links do not themselves submit your personal information in a prepared prompt. Once you open a third-party site, your interactions are governed by that provider's terms and privacy practices. We do not control those sites. Clicks on links may be measured as described in Section 2.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BY USING OUR WEBSITE, YOU ACKNOWLEDGE THAT SENDTOWIN LLC SHALL NOT BE LIABLE FOR UNAUTHORIZED ACCESS TO, LOSS OF, OR DISCLOSURE OF YOUR PERSONAL INFORMATION, OR DAMAGES ARISING FROM OR RELATED TO THE USE OF YOUR PERSONAL INFORMATION, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW. Nothing in this Policy limits nonwaivable rights or prevents a complaint to a regulator with jurisdiction.
11. INTERNATIONAL TRANSFERS
SendToWin LLC is based in the United States. Our providers may process information in the United States and other countries where they operate, which may have different privacy laws. PostHog analytics are hosted in the United States. Where required by applicable law, we use legally recognized transfer safeguards.
12. GOVERNING LAW AND DISPUTES
This Policy is governed by Florida law, subject to mandatory applicable law. Private disputes concerning the Website or this Policy are subject to the dispute-resolution provisions of the Website Terms of Use, including binding arbitration seated in Palm Beach County, Florida. This does not restrict nonwaivable rights or regulatory authority.
13. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices, technology or legal requirements. Updates will be posted on this page with a revised Last Updated date. Where applicable law requires additional notice or consent, we will provide that notice or obtain that consent.
